1. Two Kinds of Message, Two Different Rules
Service messages
Security codes, login alerts, password resets, billing receipts, renewal reminders, identity and credit alerts you switched on, and legally required notices. These come with having an account. You cannot switch them off while the account is open, because they are how we protect you, but you can close the account.
Marketing messages
Offers, product news, promotions, and anything intended to sell you something. These require your separate, affirmative, written consent, given by an action that does nothing else. You can withdraw that consent at any time and it costs you nothing.
Consent is never a condition of anything. You are not required to agree to marketing calls or texts in order to open an account, buy a subscription, be matched with a provider, or receive any service. If you ever see a Banrox form that appears to require it, that form is wrong. Report it to [email protected] and we will fix it.
Any earlier Banrox page, footer, or form suggesting that using the site is itself agreement to marketing calls, texts, or email does not create consent, and Banrox does not rely on it. Consent to marketing exists only where you gave it through a checkbox or equivalent action that was not pre-ticked.
2. What You Agree To When You Tick the Marketing Box
The consent language on our forms reads as follows, and this is the whole of it:
Consent language. By ticking this box and clicking submit, I give Banrox Inc. my prior express written consent to send me marketing calls and text messages at the telephone number I provided, including calls and texts made using an automatic telephone dialing system or an artificial or prerecorded voice. I understand this consent is not a condition of purchasing any goods or services. Message and data rates may apply. Message frequency varies. I can reply STOP at any time to stop.
We keep a record of that consent: the exact text you saw, the date and time, the internet address it came from, and the page it was on. You may request your record at [email protected].
3. Text Message Program Terms
- Programs. Banrox Alerts, which carries the service messages described above, and Banrox Offers, which carries marketing and requires separate consent.
- Frequency. Alerts vary and depend on activity on your account. Offers is limited to a maximum of 8 messages per month.
- Cost. Message and data rates may apply. Banrox charges nothing for texts. Your carrier may.
- To stop. Reply STOP, END, QUIT, UNSUBSCRIBE, or CANCEL to any message. We send one confirmation and then nothing further from that program.
- To get help. Reply HELP, email [email protected], or call (888) 888-6401.
- Carriers. Carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice.
- Your number. Tell us when you change or give up a phone number, so a message meant for you does not reach the next person who is assigned it.
4. Telephone Calls
- We call only between 8:00 in the morning and 9:00 in the evening in your local time, and we do not call on a day a state prohibits it.
- Every call identifies Banrox by name at the start, and gives a telephone number you can call back.
- We maintain an internal do not call list, we honour a request to be added to it immediately, and we keep the entry for at least five years.
- We honour the National Do Not Call Registry for marketing calls.
- Calls may be monitored or recorded for quality, training and dispute resolution. Where a state requires the consent of everyone on the line, you are told at the start and may ask us not to record without losing service.
- We do not use an artificial or prerecorded voice for marketing without your prior express written consent, and we do not make marketing calls to a number you have asked us to stop calling.
5. Email
- Every marketing email carries a working unsubscribe link and our physical postal address.
- Unsubscribes take effect within 10 business days, and normally within minutes.
- Subject lines and sender names describe the message honestly. We do not disguise a marketing email as a service notice.
- We do not sell or rent your email address, and we do not send you email on behalf of a third party.
- Transactional and account email continues after you unsubscribe from marketing, because the law treats it differently and because you need it.
6. Withdrawing Consent, in Any Reasonable Way
You may revoke consent to marketing calls, texts, or email by any reasonable method, and we honour it however it arrives. That includes:
- Replying STOP or any similar word to a text
- Clicking unsubscribe in an email
- Telling any Banrox agent by phone or chat
- Emailing [email protected] or [email protected] with any wording that makes your meaning clear
- Writing to Banrox Inc., Attn: Legal, 40 N Altadena Dr, Ste 105, Pasadena, CA 91107
- Using the communication preferences in your account
A revocation is honoured within 10 business days at the outside, and in practice immediately for text and email. We do not ask you to use one exclusive method, we do not require a specific word, and we do not require you to state a reason. Revoking marketing consent does not affect service messages or your account.
7. What Happens When You Ask to Be Matched With a Provider
If you ask Banrox to match you with a lender, bank, card issuer, or insurer, that provider will contact you about your request. Any consent you gave that provider on our form is a consent to that provider, and only to the providers named or described on the form you saw. Banrox does not place your number on a shared list, does not sell it into a bidding exchange, and does not give it to companies you did not ask about.
To stop a provider contacting you, tell that provider. We will tell you which providers received your request if you ask at [email protected], and we will pass on your stop request as well.
8. State Rules That Go Further Than Federal Law
Some states impose stricter requirements on calls and texts than federal law does, including limits on the number of calls, restrictions on calling times and days, and rules on consent given through a lead form. Banrox applies the strictest applicable rule to every recipient rather than varying by state. If you live in Florida, Oklahoma, Maryland, or Washington, or in any other state with a telephone solicitation statute, those protections apply to you and we do not ask you to waive them.
9. If Someone Contacts You Pretending to Be Banrox
Banrox will never ask you for your full Social Security number, your password, a one time security code, your card CVV, or a payment in gift cards, cryptocurrency, or a wire transfer. Banrox will never call to tell you your account is compromised and ask you to move money to keep it safe. If someone does any of that while claiming to be Banrox, hang up and report it to [email protected] or call (888) 888-6401 using the number on this site rather than a number the caller gives you.
10. Complaints
If you believe you received a message you did not consent to, write to [email protected] with the number or address and the date. We will find the consent record or confirm that there is not one, tell you which, and stop the contact either way. You may also complain to the Federal Communications Commission at fcc.gov/complaints, to the Federal Trade Commission at reportfraud.ftc.gov, or to your state attorney general. See Complaints, Disputes and Regulator Contacts.
